Fifth Committee Report: 14-29 May 2007

During the past two weeks, Fifth Committee delegates reportedly continued discussions on the Reform of the Oversight and Governance systems of the UN. A draft resolution establishing the Indepedent Audit Advisory Committee (IAAC) and deciding the modalities for the strengthening of the Office of Internal Oversight Services (OIOS) is currently under negotiation. Member States also discussed the Financial Situation of the UN. Other matters on the agenda of the Fifth Committee include: a draft resolution regarding peacekeeping cross cutting issues, and the financing of Missions in Kosovo, Georgia, Cyprus, Middle East and Liberia

OVERSIGHT AND GOVERNANCE REFORM
During the past few weeks Member States continued negotiations on the terms of reference of the IAAC and the strengthening of the Office of Internal Oversight Services at ‘informal informals’ meetings.

TERMS OF REFERENCE FOR THE IAAC:
With respect to the selection of the members of the IAAC, the membership is divided on the issue of who should nominate the candidates for the IAAC to the GA. The G77 proposed that a Nomination Committee, composed by the Secretary-General (SG), the President of the General Assembly (PGA), the Chairman of the Advisory Committee on Administrative and Budgetary Questions (ACABQ) and the Chairman of the International Civil Service Commission (ICSC), be established.

The EU and CANZ do not agree with this proposal, preferring an arrangement that would have an outside body, such as IFAC (International Federation of Accountants) or INTOSAI (International Organization of Supreme Audit Institutions) to propose potential candidates to the GA for appointment to the IAAC. Outside expertise would guarantee the independence of the selection from any internal UN constituency. The G77 and China, however, do not favor this. The G77 finds both organizations to be distinctly western oriented and fears that they would be biased in their choice of candidates, and the Group has much insisted on the importance of a geographically balanced membership of the IAAC. In addition, China expressed objections to IFAC as Taiwan is a member of the organization.

Conditions of service for the members of the IAAC were also discussed. The EU insists that the operational and financial independence of the candidates be guaranteed, and to this end it suggests that IAAC members be compensated through a flat fee reimbursement. Other Member States however seem to think this issue of less importance, and most agree on compensation through a per diem, or daily subsistence allowance.

With regards to the membership of the IAAC, agreement was reached that the Committee shall be comprised of five members. The members should represent each of the five regions with due regard to the principle of rotation among Member States.

While debating the rules and procedures for the IAAC, delegates looked at rules and procedures of the Committee on Contributions and of the ACABQ. Member States have not yet agreed on the reporting requirements for the IAAC. Would the IAAC report directly to the GA or through the ACABQ?

STRENGTHENING OF THE OIOS:
Member States also continued discussions on the strengthening of the OIOS. Member States are expected to approve the revised estimates for the OIOS, proposed by the Secretary General with the aim to expand its functions.

The revision of the current funding arrangements of the OIOS, which contribute to undermining its independence from management hence its overall effectiveness, will not be included in this resolution on the strengthening of the OIOS. The G77 declared that it is not ready to tackle this issue at the moment.1

Within the context of the reform of the oversight and governance systems of the UN, Member States reiterated their request that risk assessment, as a key component of internal controls, be part of the work of the OIOS which will be required to provide further support to management in implementing the risk assessment framework.

FINANCIAL SITUATION OF THE UNITED NATIONS
On Friday, 18 May 2007, Under-Secretary-General (USG) for Management Alicia Barcena, briefed Member States on the Financial Situation of the United Nations. Delivering her Statement, she warned Member States that the regular budget position of the United Nations is weaker compared to last year: unpaid assessments had risen to $1.31 billion, with 7 countries accounting for 96 per cent of the total. More than three quarters of the current unpaid contributions were owed by the United States and Japan, amounting to $785 million and $246 million, respectively.

  1. The Under Secretary General of the OIOS, Ms. Inga-Britt Ahlenius underlined how the main obstacle to OIOS independence is problems surrounding its funding arrangement for operations.

    According to the report on funding arrangements (A/61/810), two main issues need to be tackled in order to guarantee OIOS operational independence:

    1. The OIOS budget is subject to the review of the Department of Management which OIOS has oversight responsibility for
    2. OIOS negotiates funding for a third of its activities with the entities it is chartered to audit.

    It is clear that such a funding mechanism has a negative impact on the independence of the internal audit activity since the funding condition allows the auditee to influence, if not control, the audit process (MORE)

Update on Revitalization of the General Assembly: A RECAP OF DEVELOPMENTS DURING THE 65th GA SESSION

Even before heads of state from around the world gathered last week at UN headquarters in New York for the opening of the 66th annual session of the UN General Assembly, the world’s main deliberative body, continuation of the ongoing negotiations to make the Assembly more effective, efficient and relevant were assured for yet another year. Member States have been discussing the “Revitalization of the General Assembly” for the past twenty years, but according to some critics only minor improvements have been made, leaving deep-seated reforms untouched. Even though all Member States seem to agree that reform of the Assembly is vital, recent developments confirm that it is still very difficult to reach an agreement on what should be done.

Panel on Improving Security Council Working Methods
On 23 June 2011, The Center for UN Reform Education held a panel discussion on “Improving the Working Methods of the Security Council”. The basis for the discussion was the most recent version of the S5 draft proposal on Reforming the Working Methods of the Security Council.



Qatar hosts workshop on Security Council Reform
On 12 & 13 May 2011, Qatar hosted a workshop on Security Council Reform in Doha. Lydia Swart of the Center was invited and she shared ten observations on this key reform process.

To move the process along, Member States, the Chair of the Intergovernmental Negotiations, and/or the President of the General Assembly will need to provide leadership by proposing a timeline/trajectory for the negotiations and by formulating a compromise solution that can garner support from all factions.



S5 presents draft resolution on Improving the Working Methods of the Security Council

On 14 April, 2011, the Small Five Group (S5), consisting of Costa Rica, Jordan, Liechtenstein, Singapore and Switzerland, presented a draft resolution for Improving the Working Methods of the Security Council. The resolution was presented under agenda item 115 of the General Assembly (GA) that deals with follow-up to the outcome of the Millennium Summit. The S5 had presented its first draft resolution on the topic (A/60/L.49) in 2006 also as follow-up to the 2000/2005 Summits.

Update on Security Council Reform

Since the Center’s latest update of 22 June 2010, Members States conducted text-based negotiations on 21 October 2010, 11 November 2010, 14 December 2010, and on 2 March 2011 in their efforts to reform the Security Council. Some countries apparently continue to slow down the negotiations, while others may push for a vote sooner rather than later.

Text-based Negotiations in Full Swing

On June 16th the negotiations on Security Council reform proceeded with the third meeting of the fifth round. The meeting aimed at getting member states to discuss specific language on the fourth “key issue”. Many countries seemed to have misunderstood the intention of the Chair, however, and restated their positions rather than making suggestions for specific changes to the document at hand.

Potentially Historic Text on Security Council Reform

On May 10th, Zahir Tanin, the Chair of the intergovernmental negotiations on the question of equitable representation and increase in the membership of the Security Council and other matters related to the Security Council, sent out a long-awaited fax to all member states containing a “negotiation text”. The text and the annex can be accessed on the website of the PGA. The text includes the proposals sent by member states to Tanin's office since he opened the process of moving towards a text-based solution.

Open Debate on the Working Methods of the Security Council

On April 22nd, the Security Council’s Informal Working Group on Documentation and Other Procedural Issues held an open debate on the working methods of the Council. The debate raised some key questions that are relevant to the ongoing Security Council reform negotiations. Furthermore, to keep the issue of its working methods on the agenda of the Security Council is, in and of itself, an accomplishment.

A New Phase in Security Council Reform Has Started

On February 5th, the Chair of the intergovernmental negotiations on Security Council reform, Ambassador Tanin of Afghanistan, sent out a letter to all member states with an attachment of sixty pages. The document (available here and here) includes all “substantive input” submitted by Member States to the Chair thus far in the fourth round of negotiations. This marks the beginning of the fifth round, which, for the first time, will be text-based.

Moving Towards Text-Based Negotiations?

The previous month was an eventful one in terms of the Security Council reform process. On December 23rd, a group of countries sent a letter to the Chair of the intergovernmental negotiations, Ambassador Tanin of Afghanistan, urging him to present a composite paper. Following that, Tanin received a number of other letters concerning the process and on January 14th he replied with his own letter to all member states. This all culminated in the latest round of negotiations on January 19th and 20th in which the consequences of the letter exchanges were discussed.
